Gotham Cigars “Summer” Sweepstakes Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The Gotham Cigars “Summer” Sweepstakes begins at 12:00:01 a.m., Eastern Standard Time (“EST”) on June 1, 2010 and ends at 11:59:59 p.m., (“EST”) on August 31, 2010 ("Sweepstakes Period"). Sweepstakes is sponsored by Gotham Cigars, 8803 NW 23 Street, Miami, FL 33172 (the "Sponsor"), who is solely responsible for all aspects of this Sweepstakes.

Eligibility: Sweepstakes is open to all legal residents of the fifty (50) United States, who are 18 years of age or older as of June 1, 2010. Employees, officers, and directors (including immediate family members and members of the same household) of Gotham Cigars, American Sweepstakes & Promotions Co., their affiliated companies, subsidiaries, advertising and promotion agencies, and any other entities directly associated with this sweepstakes (collectively, “Released Parties”), are also not eligible to participate. All federal, state and local laws and regulations apply. Void where prohibited.

Two Ways to Enter: 1) During the Sweepstakes Period, eligible participants can be entered into the Sweepstakes by going to the Sponsors’ Sweepstakes website, http://www.GothamCigarsSweepstakes.com, and completing the online registration form. Within the registration form, participants will be asked to provide their first name, last name, complete mailing address (no P.O. boxes), daytime telephone number, and e-mail address. Also, participants must provide email addresses (at least one) of friends, family, and/or associates. There is no limit on number of email addresses that an entrant can provide.

Following entry, an automatic confirmation email will be sent to the entrant’s registered email address. Each entrant will receive an individual/unique code via the automatic email. Entrants’ can supply the unique code to all friends/family members/associates that he/she provided an email address for upon registration. During the Sweepstakes Period, for every $1 (one USD) that a provided friend/family member/associate spends on http://www.GothamCigars.com (using the unique code supplied by entrant), the registered entrant will receive one (1) Sweepstakes entry (EXAMPLE: $500USD spent = 500 Sweepstakes entries). NOTE: Sweepstakes entries will not be rounded up or down due to cents (EXAMPLE: $500.89USD = $500 Sweepstakes entries).

Once submitted, an Online Entry cannot be deleted, canceled or modified. Enter using only an e-mail address subscribed and registered in your name.

In the event of a dispute as to Online Entries submitted by multiple individuals using the same e-mail account, subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. An entrant may be required to show proof of being the authorized account holder.

2) Participants can also enter by hand printing on a 3”x 5” card, your first name, last name, complete mailing address (no P.O. boxes), daytime telephone number, and e-mail address. Mail the card in a business envelope to: Gotham Cigars “Summer” Sweepstakes, 90 Rockwood Place, Rochester, NY 14610. All mailed entries must be postmarked by August 31, 2010 and received by September 5, 2010.

Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the Grand Prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Sweepstakes Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sweepstakes Entities are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address

Prizes: Following the conclusion of the Promotion, one (1) Grand Prize winner, one (1) First Prize winner, and one (1) Second Prize winner will be selected at random. The Grand Prize winner will receive a Mitsubishi 46"1080p LCD HDTV. The Grand Prize has an Approximate Retail Value (“ARV”) of $1,440. The sole First Prize winner will receive a Apple iPad (16GB - Wi-Fi) with and ARV of $500. The Second Prize winner will receive a Char-Broil Grill T-Frame 7 (ARV - $130). Any additional taxes and expenses are the sole responsibility of each prize winner. All prizes will only be awarded to the verified prize winner. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. Prize Conditions: All prize winners are solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. The Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Liability / Publicity Release within 14 days of written notification or prize winner will be disqualified. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner’s entry within three (3) days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected.

Drawing and Notification: All prize winners will be selected, from among all eligible entries received, in a random drawing on or about September 10, 2010, by American Sweepstakes & Promotion Co. (“the Administrator”) an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. The Grand Prize winner will be contacted by telephone and will receive a USPS mail package of prize confirmation.

Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local laws. By entering the Sweepstakes, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and prize suppliers, and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules. This Sweepstakes is void where prohibited.

Winners List Requests: To request confirmation of the name and address of the winner, please send a self-addressed, stamped business size envelope, by October 31, 2010, to: ASC/Gotham “Summer” Sweepstakes Winner’s List Request, 300 State St. Suite 402, Rochester, NY 14614.
